Getting Ready To Place My Heirloom Seed Order… BUT!

SO!!! Much. Fun, flipping through Organic and Heirloom Seed web catalogs and postings, getting ready to order unusual heirloom seeds for this years garden. With the windfall from my IJustRead. It win, I decided to use part of the money to purchase a grow light setup for my basement for my veggie and herb seeds, and then to use part to purchase heirloom seeds from small growers selling seeds on Amazon.

I had no Idea what a confusing bunch of nonsense I was going to be embroiling myself in! See, here’s the thing . . . There are lots of people advertising “Organic/Open Source/Heirloom” seeds on Amazon. Available in small packs, there are some really interesting varieties they claim are all, or some, of the above. Take, for instance, the Hillbilly Tomato. From Wikipedia: Hillbilly Hillbilly Tomatoes - Seeds from Terra Edibles - Late. A huge bi-colour (bright yellow with red marbling) potato-leaf tomato, good slicer. Rich sweet flavour. Said to originate from West Virginia.: Tomato, also known as the “hillbilly potato leaf tomato”, scientific name Solanum lycopersicum, is an heirloom cultivar originating from West Virginia in the 1800s. This fruit is considered a beefsteak tomato weighing 1-2 pounds. It is round, heavily ribbed and its skin and flesh is orange- yellow with red streaks. The flavor is described “sweet and fruity” and is low in acid.[1] [2] [3]

It is on my “Seriously considering planting” list. So, as I am looking through Amazon seed listings, I saw this one and added it to my wish list, where I am gathering all the different things I like – then whittling the list down to what I can actually fit in my garden (big sigh).

But there, Horatio, is the rub. For you see, that particular vendor imports the seeds from China.

So, I started doing some digging…. and digging…..  and digging……………………

And learned quite a few things. There are Chinese laws about “organic.” There are American laws about “organic.” And never, ever, shall the twain meet. . .

The Chinese are now requiring that the Americans meet their particular organic regulations on imports, as we have required them to meet our regulations on organics . . . but they don’t come close to matching (and of course American exporters are all up in arms that they have to meet “expensive” export regulations. Big sigh.)

I dug deep on marketing laws, organic specifications between the two countries, etc. ad nauseum. I was looking, hard for rules about whether you could market seeds as organic, open source, etc. if they are imported from other countries. I found laws regarding endangered plant species, phytosterility, and all sorts of other little goodies dealing with small batch seed imports. But the more I read, the more ‘confusticated’ I got about my original question – should sellers be required to tell buyers that their supposedly organic seeds are imported from other countries? Are these seeds even close to being what they are marketed as? This particular seller had multiple reviews indicating the seeds, 1) Didn’t arrive because US Customs seized them, 2) Didn’t sprout, or 3) If they did sprout, they weren’t what the customer had ordered but some other tomato entirely. OK. Not good. I had wanted to buy from small, independent growers, and my Amazon credit – – – but if this is what I can look forward to, forget it. It looks like Territorial Seed Company is getting my business again this year!

I finally sent a letter to US Customs and Border Protection (since they are the ones who stopped the other customer’s seeds from coming through customs) as follows:

I recently nearly ordered vegetable seeds that were advertised as “Organic” from a company on, but reading reviews I noted that the seeds were imported from China and orders had been held by US Customs. There were other issues with that particular seller as well (which I addressed with Amazon) but my questions are:

1. Are companies who are selling Chinese imports required by law to notify American Consumers that they are doing so?

2. Are there strict laws in place that require Chinese seed sources to prove via chemical testing that they truly Are organic and non GMO?

I have read the phytosanitary regulations and USDA APHIS, but I can’t find clear and unassailable information. I find differing information on the internet, and I don’t trust any of it. I want to be absolutely certain that any seeds I buy are organic, open sourced, and (in my case) heirloom varieties – but I have found that more than one supplier out there is actually selling Chinese imports that, until you receive them from a Singapore address, or receive a letter from US Customs saying the product was destroyed, you have no way of knowing for sure are imported.

Your clarification would be greatly appreciated – and will be happily spread to my organic gardening groups!
I wonder if they will answer? They do say it can take three weeks or so for a response from a customer service agent. And if they do, what the response will be?  Have you thought about these questions? Do you plant heirlooms, organics, open source and/or non GMO seeds? Inquiring minds want to know!

Glory Be, I Can See!!

I had Lasix surgery over 15 years ago, and it was wonderful! I went from being nearly unable to see to 20/20 in one eye and 20/15 in the other. It was the first Lasix of its kind on a set of eyes that were, before then, thought unable to be worked on. The doc actually wrote a journal article about it, which was cool as she did it for a huge discount in order to be able to test it out on someone with my level of nearsightedness. The surgery worked until my chemotherapy, when, along with the rest of my body, my eyes took a huge hit and didn’t recover. So, I haven’t been able to see anywhere near as well over the last three years. And I couldn’t read paper volumes at all. Pretty sad when I have over 1,000 books in my library!

But today, I can see! Glory be, I can see! (And I also see that I really need a haircut!)

Doin’ my happy dance!

Yep! Now I can read those paperbacks authors were kind enough to send me. Sometimes there is nothing like the scent and feel of paper books. So good!

On another note, Linda did her first baking with the new KitchenAid I got her for her birthday. Look what I have for breakfast! Strawberry/blackberry on the left, almond on the right. Let the yummy begin!

Hum… Well, I Could Certainly “Use” A Brain Reboot!

I admit it. The old gray matter doesn’t work like it used to. Let’s face it – I spend way too much time wandering around the house looking for what I just had in my stinking hand!

This book has been on a lot of reading lists lately. The question is – is it all mumbo-jumbo? Cause I really, reallly would like to know where I put my Zune… or maybe it is just the Gremlins that live behind the baseboards? Hum…

HOPESBeing me, I started doing research. HOPES, Huntington’s Outreach Project for Education, at Stanford, has an interesting article online about diet and Neurogenesis that indicates that this is something we should all be paying attention to. The jury is still out, of course, as scientific studies take time. But as the last line of the article says, ” In conclusion, eating healthy might promote neurogenesis – but even if it does not, a healthy diet certainly will not hurt.”

I don’t know if this book is any good or not. I haven’t read it. But the idea is worth study, especially for us on the upper side of ** (grin). It does concern me that the author is not a physician or a scientist, but a psychologist. Not exactly the chops for writing a book based on scientific enquiry. I wouldn’t rely just on this book to gain all my information by any means. However, it might be a good starting place? It is $0.99, or Free if you have Kindle Unlimited. Then do some online research from the major medical research universities: Harvard, Yale, Stanford, etc. and make your own decisions. It does sound interesting, though…

(The following information was taken from – I don’t take responsibility for anything said below!!)

“The most important book you’ll read this year.”

The Neurogenesis Diet and Lifestyle brings together the latest in neuroscience research to present a new and proven view of brain health and aging.

Only recently has it been discovered that the brain produces new brain cells throughout our entire lives, a process called neurogenesis. The rate at which we form new brain cells has a profound influence upon every aspect of our life. When the rate of neurogenesis is low, we see cognitive deficits and memory problems, anxiety and stress, depression, and lowered immunity. Life is difficult.

With high rates of neurogenesis we see the opposite: enhanced cognitive abilities, rapid learning, emotional resilience, protection from anxiety, stress and depression, heightened immunity and robust health. We flourish. Life is wonderful.

Given the neurotoxic norms of society, it’s almost universally true that your brain is working far below its capacity. It is deteriorating much faster than it needs to. What good is living longer if your brain can’t go the distance?

Recent discoveries in the emerging field of neurogenesis reveal the secrets to radically improve your brain’s health. You can operate at a higher level than you ever dreamed possible – at any age!

”A revolutionary paradigm shift in brain health and brain aging.”

This scientifically validated, 4-point program of diet and lifestyle will:
• Improve your memory and brain power
• Inoculate you against stress and depression
• Prevent or delay cognitive decline, dementia and Alzheimer’s
• Enrich your relationships and sex life
• Help you connect with your loving center of peace

This book presents the latest neuroscience discoveries to increase brain power, enhance memory, increase brain fitness by seeing what kinds of brain exercises actually work, and build a better brain. It contains dietary recommendations for brain food, brain vitamins, brain supplements, memory vitamins and memory supplements.

“This is the best book to give anyone over 50!”

This book also spells out the symptoms of dementia, the stages of dementia, signs of cognitive decline and stages of Alzheimer’s. The plan presented in The Neurogenesis Diet and Lifestyle will help to ward off cognitive decline and avoid dementia stages. This lifestyle is the only lifestyle for which there is scientific evidence supporting it, based on a late 2014 research study by the Buck Foundation.

The Neurogenesis Diet and Lifestyle is aimed at improving how your brain functions. Your rate of neurogenesis may be the most important factor in your brain health. And increasing your rate of neurogenesis by three to five times can result in powerfully improved memory, learning, cognitive enhancement, as well as improved immunity and protection against stress and depression.

You can live and perform well beyond where you are now.

Writers Sit . . . Editors Do As Well!

Being raised on a horse farm by a sociopath, (Really. Who puts a 6-year-old on a bronc?) I found my way onto a lot of broncs. Like, a lot.

Broken bones, shattered tibia, and more than one instance of cracked/slipped vertebrae – add in the 1,000+ stitches from having my throat ripped out, arm ripped off and the side of my face removed (slamming through fences  can be brutal…) the older you get – the more you start to feel like a bag of busted bits and pieces. Groan… And the longer I sit, editing, reviewing, or just plain reading (or knitting, or quilting….) I have a tendency to let hours go by, lost in my work, without getting off my butt and moving around — especially dumb since I have two bad disks in my back. Sigh. So… Not surprising to wind up in hospital this week with screaming agony in my back and hip and down my leg. OUCH!! Like, really – O.U.C.H.  So, days of bed rest and lots and lots of Oxy and muscle relaxers, and knock-out drugs, and I decided – well, crap. I took enough drugs during chemo! Besides, there are way too many people out there addicted to Oxy – and I don’t want to be one of them!

What to do, what to do? Well, what I used to do! Not just exercises, but the appropriate exercises. And since we are all writers and reviewers, and sit a long time, I thought I would show you some of the exercises I am doing to lessen the compression on my L2 vertebrae and wipe out the pain. Honestly, it is working Great! You don’t have to have disk compression to gain from these exercises – and they are simple to do and don’t take a lot of time. Whenever you get up and walk around,  you can do a few and keep yourself supple!

NOW REMEMBER!!!! I AM NOT A PHYSICIAN, A PHYSICAL THERAPIST, A YOGA SPECIALIST – ANY OF THOSE THINGS. ALL INFORMATION GIVEN IS LINKED BACK TO THE ORIGINAL SITES. states on their website: “Written or reviewed by a board-certified physician. See’s Medical Review Board. ” I also referenced the Mayo Clinic website. Take your time, don’t do too much, and check with your doctor before beginning ANY exercise regime.

The doctor at the emergency room just pumped me with morphine – which helped till the morphine wore off… but I have been comfortable all day today after doing stretching exercises. So, I still have my pills for emergencies, but at least I didn’t sleep all day in an Oxycontin induced coma!

Heaven Stretch: Heaven Stretch is an important decompressing exercise that is extremely helpful for preventing and reducing low back pain and improving posture. Start in a standing position with your feet shoulder width apart and your palms together in front of your chest. Take a moment to concentrate on your breathing. Take a deep breath in and slowly reach toward the sky with fingertips pointing up and in.

Breathe in through your nose and keep reaching while holding your breath at the top of the exercise. Hold the stretch at the top for as long as you are comfortable. Then, breathe out through your mouth while slowly bringing your arms down to your sides with your palms facing downward. Make a large circle with your fingertips as you bring your arms down. Return to ready position and relax before repeating exercise.

Spinal Rolls: Spinal rolls are an excellent exercise designed for increasing range of motion in every area of the spine, from the neck all the way to the lower back.  Start by taking a wide stance on your mat with your knees soft and relaxed. Then, slowly bend your head, with arms and shoulders hanging loosely. Try to imagine rolling one vertebrae at a time as you reach toward the mat in front of your feet.

Go as far as you can comfortably with knees in squatting type position. Ideal position at bottom of exercise is placing palms on ground while letting head hang loosely to traction shoulders.  If you are not able to put your hands on the mat in front of you, simply roll down as far as you are comfortable with arms hanging loosely in front  of you.

Reverse order on way up.  Concentrate on rolling up the spine, one vertebra at a time.  Round your lower back, then the area between your shoulders and then your neck.  End in ready position looking straight ahead.  Repeat exercise by bending your neck and rolling down again. (This is one of my favorite exercises – feels so good afterwards!)

Butterfly stretchButterfly Pose: Sit upright on the floor with the soles of your feet together and as close to your body as is comfortable. Gently press down on both knees with your hands for 30 seconds; repeat three times. Then lie on the floor with your knees bent and your feet flat. Cross one ankle over the opposite thigh, and pull that thigh toward you with both hands. Hold for 30 seconds; repeat three times for each leg.

And strengthening your core is the only way you are going to keep the progress you make! From

The Plank Abdominal Exercise:

The basic plank exercise, also called a hover, is the starting place if you want to improve your core strength and stability. Here’s how to do it right.

Begin in the plank position (see photo) with your forearms and toes on the floor.

Keep your torso straight and rigid and your body in a straight line from ears to toes with no sagging or bending.

Hold this position for 10 seconds to start.

Over time work up to 30, 45 or 60 seconds.

I will keep adding in exercises as I get stronger, but just this small bit is already helping!

Books For The “Serious Reader” On Your Holiday List

For the more serious readers on your holiday list, I thought I would toss out some ideas today from my own “Must Read” list. Of course, that list gets set aside when I am busy, but I am working my way down!

6493208The Immortal Life of Henrietta Lacks

Her name was Henrietta Lacks, but scientists know her as HeLa. She was a poor black tobacco farmer whose cells—taken without her knowledge in 1951—became one of the most important tools in medicine, vital for developing the polio vaccine, cloning, gene mapping, and more. Henrietta’s cells have been bought and sold by the billions, yet she remains virtually unknown, and her family can’t afford health insurance. This phenomenal New York Times bestseller tells a riveting story of the collision between ethics, race, and medicine; of scientific discovery and faith healing; and of a daughter consumed with questions about the mother she never knew.

The Hot Zone: The Terrifying True Story of the Origins of the Ebola Virus

The bestselling landmark account of the first emergence of the Ebola virus. A highly infectious, deadly virus from the central African rain forest suddenly appears in the suburbs of Washington, D.C. There is no cure. In a few days 90 percent of its victims are dead. A secret military SWAT team of soldiers and scientists is mobilized to stop the outbreak of this exotic “hot” virus. The Hot Zone tells this dramatic story, giving a hair-raising account of the appearance of rare and lethal viruses and their “crashes” into the human race. Shocking, frightening, and impossible to ignore, The Hot Zone proves that truth really is scarier than fiction.

Virus Hunter: Thirty Years of Battling Hot Viruses Around the World

by C.J. Peters, Mark Olshaker

A New York Times Notable Book249716

The man who led the battle against Ebola in The Hot Zone teams up with the bestselling co-author of Mind Hunter to chronicle his extraordinary thirty-year career fighting deadly viruses.

For three decades, Dr. C. J. Peters was on the front lines of our biological battle against “hot” viruses around the world. In the course of that career, he learned countless lessons about our interspecies turf wars with infectious agents. Called in to contain an outbreak of deadly hemorrhagic fever in Bolivia, he confronted the despair of trying to save a colleague who accidentally infected himself with an errant scalpel. Working in Level 4 labs on the Machupo and Ebola viruses, he saw time and again why expensive high-tech biohazard containment equipment is only as safe as the people who use it.

Because of new, emerging viruses, and the return of old, “vanquished” ones for which vaccines do not exist, there remains a very real danger of a new epidemic that could, without proper surveillance and early intervention, spread worldwide virtually overnight. And the possibility of foreign countries or terrorist groups using deadly airborne viruses—the poor man’s nuclear arsenal—looms larger than ever.

High-octane science writing at its best and most revealing, Virus Hunter is a thrilling first-person account of what it is like to be a warrior in the Hot Zone.

Third World America: How Our Politicians Are Abandoning the Middle Class and Betraying the American Dream

by Arianna Huffington (Goodreads Author), Coleen Marlo (Goodreads Author)

It’s not an exaggeration to say that middle-class Americans are an endangered species and that the American Dream of a secure, comfortable standard of living has become as outdated as an Edsel with an eight-track player—that the United States of America is in danger of becoming a third world nation.

The evidence is all around us: Our industrial base is vanishing, taking with it the kind of jobs that have formed the backbone of our economy for more than a century; our education system is in shambles, making it harder for tomorrow’s workforce to acquire the information and training it needs to land good twenty-first-century jobs; our infrastructure—our roads, our bridges, our sewage and water, our transportation and electrical systems—is crumbling; our economic system has been reduced to recurring episodes of Corporations Gone Wild; our political system is broken, in thrall to a small financial elite using the power of the checkbook to control both parties.

And America’s middle class, the driver of so much of our economic success and political stability, is rapidly disappearing, forcing us to confront the fear that we are slipping as a nation—that our children and grandchildren will enjoy fewer opportunities and face a lower standard of living than we did. It’s the dark flipside of the American Dream—an American Nightmare of our own making.

Arianna Huffington, who, with the must-read Huffington Post, has her finger on the pulse of America, unflinchingly tracks the gradual demise of America as an industrial, political, and economic leader. In the vein of her fiery bestseller Pigs at the Trough, Third World America points fingers, names names, and details who is killing the American Dream. Finally, calling on the can-do attitude that is part of America’s DNA, Huffington shows precisely what we need to do to stop our freefall and keep America from turning into a third world nation.

Third World America is a must-listen for anyone disturbed by our country’s steady descent from twentieth-century superpower to backwater banana republic.

90-Year-Old Florida Man Facing Jail Time After Feeding Homeless

Floridians should be ASHAMED!!!

It took FOUR armed officers to arrest a 90-year-old man for feeding the hungry. Four.

Two pastors and an elderly advocate for the homeless have reportedly been charged for feeding the underprivileged. The issue stems from a recently-passed city ordinance in Fort Lauderdale, Florida that makes sharing food with the homeless an offense.

Watch the video below from . There are FOUR POLICE OFFICERS arresting a 90-year-old man for feeding the hungry. Florida, where the following is listed at the Florida Crime Statistics and Rates Report:
2012 Crime (Actual Data) Incidents
Aggravated Assault 63,929
Arson N/A
Burglary 153,563
Forcible Rape 5,260
Larceny and Theft 442,095
Motor Vehicle Theft 37,330
Murder and Manslaughter 1,009
Robbery 23,889
Crime Rate (Total Incidents) 727,075
Property Crime 632,988
Violent Crime 94,087
The number of police officers, including sheriff’s deputies, in Florida? 1.7 per 1,000 citizens.
Is anyone other than me TOTALLY APPALLED? And remember this – Florida is where this country’s federal elections are won or lost. Do we really want this state’s kind of cruelty to decide our fate as a nation?
If you find this as nasty as I do, I hope you will feel free to repost.

Review: Meridian Qigong by Tevia Feng

meridianHarmony makes small things grow, lack of it makes great things decay. – Sallust

We have finally started to notice that there is real curative value in local herbs and remedies. In fact, we are also becoming aware that there are little or no side effects to most natural remedies, and that they are often more effective than Western medicine. – Anne Wilson Schaef

Qi (chee) is Chinese for air, or energy, while Gong is “work.” One moves and harmonizes life energy, moving through universal energies, balancing and healing the mind, soul and body. Through meditation, exercise and harmony of mind and body, Qigong applies the energies of the mind and body to ensure health and wellness.

While Western Medicine claims perfection using chemicals and invasive treatments, Chinese medicine is a much older, wiser style of medicine, going back millennia, through the Daoist and Buddist traditions and further. This is not to say that Western medicine doesn’t have it’s place. As a Stage IIIb cancer survivor I was not adverse to using every bit of Western medicine I could in order to overcome the horrors of cancer. Of course, the Western medicine was horrible in and of itself. But it did the job, for which I am eternally grateful. But meditation, massage, acupuncture and other, older forms of healing also played a big part in my healing. And honestly, though Qigong was not part of my healing, if I had found this book sooner, I feel very much that this too would have helped immensely to provide balance and help me to manage my pain and weakness during my chemotherapy.

I spent quite some time reading though Meridian Qigong and was very comfortable with the practice. Now, honestly, I intend to keep this book on my Nook and start actually practicing Qigong, with the help of Tevia Feng’s lovely little book. Only 120 pages long, the book is a wonderful introduction to Qigong. I hope you enjoy it as much as I did. Check it out – the practice of Qigong may be perfect to help you to balance your mind and body.

I received this book form the publisher in return for a realistic review. All thoughts are my own.

The Stop Gardner Campaign

Yet another clueless Penis getting involved in women’s health – without a CLUE as to the amount of damage he is doing. If you are a “Pro-lifer” I advise you to wake up, get a clue and research the damage you are doing to humanity as a whole. Where is your “Moral Stand” when women are being beaten and raped, tortured and murdered? Where your moralistic outrage when unwanted children are beaten, tortured, and murdered? Where is your kindness, your outrage, when the victims of incest are forced to carry to term the twisted get of their terror? Gardner, and his ilk, are twisted, misogynistic monsters who should NEVER be allowed access to any ability to make things even worse for victims. This sort of hatred and viciousness, this power to destroy the lives of victims, should NOT be allowed to stand! If you have any compassion in your soul, I hope you can be counted on to help fight this honorific person and his evil hatred of the victims of crimes. Believe me – I was an unwanted child – and the torture and viciousness I went through was nothing compared to the brutalized bodies, the broken souls, that I dealt with as a police officer and then as a victim counselor. What these sorts of people are doing isn’t kind or good, ethical or moral by any means. It is the work of cruel, vicious people who use a twisted “moral” play to exercise their power and cruelty to punish victims and contribute the the number of tortured souls littering this country. It is an outrage, and a blight on the face of humanity. These are the sorts of people that are so common in the Middle East – people who find it perfectly acceptable to murder the women in their families because they were raped by vicious attackers through no fault of their own. The same type of twisted morality that will blame the woman victim, while applauding the “manliness” of the attacker.  Moral, emotional and physical sadism in what we purport to be the “Greatest Free Country In The World.” Really? I suppose if you sport a penis you might say so . . .

Gardner Opposed Abortion In All Instances. “Markey, the Democratic incumbent from Fort Collins, supports a woman’s right to make decisions on abortion; Gardner says abortion should be illegal in all instances. ‘I’ve been very up-front on it; I am pro-life,’ Gardner, a state representative from Yuma, said in an interview with the Coloradoan. When asked if he would allow exceptions for victims of rape or incest, or when the mother’s life is in danger, Gardner said, ‘I’m pro-life, and I believe abortion is wrong.’” [Fort Collins Coloradoan, 9/26/10]

Gardner Said He Was Willing To Sponsor Legislation To Ban Abortion: “Yes, And I Have The Legislative Background To Back It Up.” “Four Republican candidates seeking the Republican congressional nomination shared a stage for the first time at a Nov. 13, 2009, forum organized by Northern Colorado tea party and 9-12 groups. They were asked, ‘Do you believe that abortion is the killing of an unborn child, and if yes, are you willing to carry legislation to end the practice?’ All four candidates – Gardner, Diggs Brown, Dean Madere and Tom Lucero – answered yes, with Gardner giving the most succinct answer. ‘Yes, and I have the legislative background to back it up,’ he said to applause.” [Fort Collins Coloradoan, 10/3/10]

2007: Gardner Co-Sponsored Senate Bill 143 Which Would “Make Abortion A Felony Even In Cases Or Rape Or Incest.” “At the heart of the ad is Gardner’s sponsorship of a 2007 proposal to make abortion a felony even in cases of rape or incest. When he was a state lawmaker, Gardner signed onto Senate Bill 143 as a co-sponsor — he did not carry the bill himself, his campaign points out.” [KDVR, 4/22/14]

Gardner Cosponsored Bill To Make Abortion A Class 3 Felony. In 2007, Gardner sponsored SB 07-143 in the Colorado General Assembly which was an anti-abortion bill that would outlaw all abortions with the exception of cases that is “designed to protect the death of a pregnant mother, if the physician makes reasonable medical efforts under the circumstances to preserve both the life of the mother and the life of her unborn child in a manner consistent with conventional medical practice.” Per the legislative text, the bill would make it “a class 3 felony to perform an abortion.” [Colorado General Assembly, SB 07-143; Fort Collins Coloradoan, 10/3/10]

  • Senate Bill 143 Would Have Banned Abortion In Cases Of Rape And Incest, Doctors “Would Face A Class 3 Felony” And A Prison Term Of Up To 12 Years. “Senate Bill 143 proposed to ban all abortions in Colorado, except when the life of the pregnant woman is at risk. This would include banning abortions to women who have been victims of rape and/or incest. Any doctors who performed abortions outside of these lines would face a third degree felony that could carry a prison term up to 12 years.” [CU Independent, 2/14/07]
  • Life News: Senate Bill 143 “Would Have Banned Most Abortions, Except In Very Rare Cases To Save The Life Of The Mother.” According to Life News, an anti-choice news outlet, “Colorado legislators voted on Monday to kill a bill that would have offered legal protection to unborn children who are victims of abortion. The measure, modeled after the abortion ban the South Dakota state legislature approved last year, would have banned most abortions, except in very rare cases to save the life of the mother.” [Life News, 2/12/07]
  • Headline & Subheadline: “Senate Bill Seeks To Ban Abortion In Colorado. Senate Bill 143 Heads To Committee” [The Denver Channel, 2/11/07]
  • “Senate Bill 143 Seeks To Ban All Abortions In Colorado With The Exception Of Situations When The Life Of The Mother Is In Jeopardy.” “An abortion bill that has created fierce debate among lawmakers and citizens will be taken up by the Senate Judiciary Committee on Monday. Senate bill 143 seeks to ban all abortions in Colorado with the exception of situations when the life of the mother is in jeopardy.” [7News Denver, 2/11/07]

9News Truth Test: “True” That Gardner Sponsored A Bill To Make Abortion A Felony. “CLAIM: ‘Gardner sponsored a bill to make abortion a felony.’ VERDICT: True. In 2007, as a member of the state House of Representatives, Gardner was listed as a sponsor of SB-147. The bill would have made it ‘a class 3 felony to perform an abortion,’ so the felony charge would have applied to abortion providers, not women who underwent abortions.” [Truth Test, 9News, 4/23/14]

9News Truth Test: “True” Gardner Supported A Bill Making Abortion A Felony In Cases Of Rape And Incest. “CLAIM: The bill Gardner supported would make abortion a felony in ‘cases of rape and incest.’ VERDICT: True. SB-147 did contain an exception to save the life of the mother. Aside from that, the bill would have outlawed abortion with no other exceptions.” [Truth Test, 9News, 4/23/14]

Gardner Supported 2010 Personhood Amendment In Colorado. “Gardner announced at a 2010 congressional debate that he had collected signatures to put a personhood amendment on the ballot. Amendment 62 failed 71 percent to 29 percent, with 1.28 million voters opposed and nearly 475,000 in support of it.” [Denver Post, 3/24/14]

July 2013: Gardner Cosponsored The Life At Conception Act. [HR 1091, co-sponsored 7/23/13]

March 2012: Gardner Cosponsored Life At Conception Act. [HR 374, co-sponsored3/20/12]

Gardner Continued Supporting Personhood As A Cosponsor Of National Personhood, Even After Saying He Flipped On Personhood In Colorado. “The second-term Congressman, who represents Colorado’s rural and conservative Fourth District, famously reversed his longtime support for the anti-abortion personhood movement in March, a month after announcing he was running for Senate. Gardner was criticized as a flip-flopper. But he hadn’t performed even a full flip. He shuffle-stepped before he left the ground and tried to have it both ways. He said he didn’t support personhood… in Colorado. He made it known to his pro-life supporters that he was still an anti-abortion lawmaker. And he continues to support as a cosponsor a national personhood bill, the so-called Life at Conception Act.” [Colorado Independent, 7/2/14]

Personhood Measures “Would Effectively Outlaw Abortions” And “Many Forms Of Contraception.” “The personhood measures would effectively outlaw abortions and, critics say, many forms of contraception. They have been overwhelmingly rejected at the polls in Colorado — the last one failed 70-30 — and have been used by Democrats to paint Republicans as extremists on social issues.” [Associated Press, 3/25/14]

Huffington Post: The Personhood Amendment Banned All Abortions, Even For Rape. According to the Huffington Post, “The personhood amendment, which would ban all abortion, even for rape, forces a discussion about when life begins and why–which can lead to religion–as we saw in the video of Rep. Cory Gardner saying he circulated personhood petitions in his church.” [Huffington Post, 3/10/14; Cory Gardner Shows Love For Personhood, Accessed 3/14/14]

2010 Colorado Personhood Amendment Would Ban Abortion In All Cases, Including Rape And Incest, In Addition To Potentially Criminalizing Doctors Who Terminated Ectopic Pregnancies And Banning Multiple Forms Of The Birth Control Pill. From a US News And World Report blog post by Democratic strategist Laura Chapin: “Like Buck, Gardner has been an enthusiastic supporter of the ballot measures that would give full legal rights to fertilized eggs in the Colorado Constitution, also known as ‘Personhood.’ This proposal would ban abortion in all cases, even for victims of rape and incest, potentially criminalize doctors who terminate life-threatening ectopic pregnancies, and ban many forms of birth control, including the IUD and some types of the Pill. There’s another Personhood measure on the ballot this year, even though the last one lost 70-30 in 2010.” [US News And World Report, Laura Chapin blog, 2/27/14]

Legislation That Defines A Fertilized Egg As A Human Being Would Ban All Abortions, Including Those Resulting From Rape And Incest, And Would Bar Common Forms Of Birth Control, Like The Moring After Pill. “A constitutional amendment facing voters in Mississippi on Nov. 8, and similar initiatives brewing in half a dozen other states including Florida and Ohio, would declare a fertilized human egg to be a legal person, effectively branding abortion and some forms of birth control as murder. […]The amendment in Mississippi would ban virtually all abortions, including those resulting from rape or incest. […] A similar measure has been defeated twice, by large margins, in Colorado.” [New York Times, 10/25/11]

2011: Gardner Was An Original Co-Sponsor Of A Bill To Prohibit Federal Funding For Abortion, Except In Cases Of “Forcible Rape,” Incest, Or Life Of The Mother. In January 2011, Gardner was an original co-sponsor of H.R. 3. According to the New York Times, “One bill, the ‘No Taxpayer Funding for Abortion Act,’ would eliminate tax breaks for private employers who provide health coverage if their plans offer abortion services, and would forbid women who use a flexible spending plan to use pre-tax dollars for abortions. Those restrictions would go well beyond current law prohibiting the use of federal money for abortion services. The bill, sponsored by Representative Christopher H. Smith, Republican of New Jersey, has drawn fire over language that undercuts a longstanding exemption on the ban on using federal money for abortions in the case of rape or incest; the measure narrows the definition of rape to ‘forcible rape,’ a term that his office has never defined. Democratic lawmakers and others repeatedly hammered on the term, saying it suggested that victims of statutory rape and other crimes could not get abortions paid for with federal money. While Mr. Smith’s staff said last week that the term ‘forcible rape’ would be removed from the bill, the staff of Representative Jerrold Nadler of New York, the top Democrat on the Judiciary Subcommittee on the Constitution, said that language remained intact as of Tuesday.” [H.R. 3, co-sponsored 1/20/11; New York Times, 2/8/11]

  • Gardner Joined Todd Akin As The Bill’s Original Co-Sponsor. According to an opinion piece by Democratic operative Laura Chapin, published in the Denver Post, “Republican vice presidential candidate Paul Ryan — along with Akin, Gardner, Lamborn and Coffman — co-sponsored the original version of HR 3. They apparently had no objection to the ‘forcible rape’ language.” [Laura Chapin, Denver Post, 8/21/12]
  • The “No Taxpayer Funding For Abortion Act” Attempted To Narrow The Definition Of Rape To “Forcible Rape.” “Ryan also cosponsored the ‘No Taxpayer Funding for Abortion Act’ with Akin in 2011. The GOP tried to narrow the definition of rape as it related to abortions with the measure. Only in instances of ‘forcible rape,’ the bill specified, would a woman be eligible to have her abortion covered under insurance. The sentiment behind the notorious attempt to redefine rape was echoed in Akin’s comment on Sunday.” [Huffington Post, 8/19/12]
  • The Term “Forcible Rape” Was Used In The Original Bill And Eventually Dropped From The Measure. According to the Washington Post, “Responding to Democratic charges that he sought to narrow the definition of rape when he co-sponsored a House measure last year that used the term ‘forcible rape,’ presumptive GOP vice-presidential nominee Paul Ryan said Monday that the phrase was ‘stock language’ and that he agreed with its eventual removal from the bill. […] The GOP-led House has passed several abortion funding-related measures this Congress, but the one that employed the term ‘forcible rape’ – H.R. 3, also known as the ‘No Taxpayer Funding for Abortion Act’ – has drawn renewed scrutiny in the wake of Missouri GOP Senate nominee Todd Akin’s remark that ‘legitimate rape’ rarely results in pregnancy. Both Akin and Ryan were co-sponsors of H.R. 3. A spokesman for Rep. Chris Smith (R-N.J.), the bill’s main sponsor, told The Post last February that the term ‘forcible rape’ was eventually dropped from the measure because it had been ‘misconstrued’ by critics.” [Washington Post, 8/27/12]

Changing Rape To “Forcible Rape” Could “Distinguish It From Other Kinds Of Sexual Assault That Are Typically Recognized As Rape, Including Statutory Rape And Attacks That Occur Because Of Drugs Or Verbal Threats.” “A Republican bill seeking to permanently cut off federal funding for abortions has angered women’s groups that say it alters the definition of rape, permitting coverage for the procedure only in cases in which the rape is considered ‘forcible.’ The bill, called the No Taxpayer Funding for Abortions Act, would make permanent several provisions that have been law for years but require annual renewal by Congress. It is a top priority of Republican leaders who took control of the House after the November elections. The most well-known provision that would become permanent under the bill is the Hyde Amendment, which prevents some federally funded health-care programs from covering abortions. For years, it has allowed exemptions in cases of rape and incest, and when the life of the woman is threatened. Under the proposed language, however, rape becomes ‘forcible rape.’ Critics say the modifier could distinguish it from other kinds of sexual assault that are typically recognized as rape, including statutory rape and attacks that occur because of drugs or verbal threats.” [Washington Post, 2/1/11]

  • National Women’s Law Center Government Relations Director: “It Speaks To A Distinction Between Rape Where There Must Be Some Element Of Force In Order To Rise To The Standard, And Rape Where There Is Not.” From an article on H.R. 3: “A Republican bill seeking to permanently cut off federal funding for abortions has angered women’s groups that say it alters the definition of rape, permitting coverage for the procedure only in cases in which the rape is considered ‘forcible.’ […] ‘It speaks to a distinction between rape where there must be some element of force in order to rise to the standard, and rape where there is not,’ said Steph Sterling, director of government relations for the National Women’s Law Center. ‘The concern here is that it takes us back to a time where just saying no was not enough.’” [Washington Post, 2/1/11]

H.R. 3 Would Alter The Definition Of Rape To “Forcible Rape” Which “Would Rule Out Federal Assistance For Abortions In Many Rape Cases, Including Instances Of Statutory Rape, Many Of Which Are Non-Forcible.” “For years, federal laws restricting the use of government funds to pay for abortions have included exemptions for pregnancies resulting from rape or incest. (Another exemption covers pregnancies that could endanger the life of the woman.) But the ‘No Taxpayer Funding for Abortion Act,’ a bill with 173 mostly Republican co-sponsors that House Speaker John Boehner (R-Ohio) has dubbed a top priority in the new Congress, contains a provision that would rewrite the rules to limit drastically the definition of rape and incest in these cases. With this legislation, which was introduced last week by Rep. Chris Smith (R-N.J.), Republicans propose that the rape exemption be limited to ‘forcible rape.’ This would rule out federal assistance for abortions in many rape cases, including instances of statutory rape, many of which are non-forcible.” [Mother Jones, 1/28/11]

H.R. 3 Would Alter The Definition Of Rape To “Forcible Rape” Which Would Not Include “Rapes In Which The Woman Was Drugged Or Given Excessive Amounts Of Alcohol, Rapes Of Women With Limited Mental Capacity, And Many Date Rapes.” “With this legislation, which was introduced last week by Rep. Chris Smith (R-N.J.), Republicans propose that the rape exemption be limited to ‘forcible rape.’ […] Other types of rapes that would no longer be covered by the exemption include rapes in which the woman was drugged or given excessive amounts of alcohol, rapes of women with limited mental capacity, and many date rapes. ‘There are a lot of aspects of rape that are not included,’ Levenson says.” [Mother Jones, 1/28/11]

Critics Of H.R. 3 Said “Forcible Rape” Legislation “Would Exclude Victims Of Statutory Rape Or Rapes Involving Drugs.” “The legislation — known as the No Taxpayer Funding for Abortion Act — was first introduced on July 29, 2010 by New Jersey Congressman Chris Smith (R-4th Dist.). […] After the GOP took control of the House, Smith re-introduced the bill on Jan. 20, 2011. Again, at the time of introduction, Ryan and Akin became co-sponsors, and the legislation still contained the phrase ‘forcible rape.’ […] Yet that term ignited an outcry among various critics, who said the phrase would exclude victims of statutory rape or rapes involving drugs.” [Politifact, 8/22/12]
